Temporal Art - Terms of Service

YOU ACKNOWLEDGE AND AGREE THAT, BY ACCESSING OR USING THE SITE OR SERVICES OR BY PURCHASING WORK(S) ON OR THROUGH THE SITE, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS. If you accept or agree to these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms and, in such event, "you" and "your" will refer and apply to that company or other legal entity.
Temporal Art reserves the right, at its sole discretion, to modify, discontinue or terminate the Site or Services or to modify these Terms, at any time and without prior notice. If we modify these Terms, we will post the modification on the Site or provide you with notice of the modification. We will also update the "Last Updated Date". By continuing to access or use the Site or Services after we have posted a modification on the Site or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the Site and Services.
The Site and Services are intended solely for persons who are 18 or older. Any access to or use of the Site or Services by anyone under 18 is expressly prohibited. By accessing or using the Site or Services you represent and warrant that you are 18 or older.
Images are sold in two distinct forms and require the purchaser to complete purchaces online via the web galleries:
Numbered Editions – all artwork will be sold as described on the website and in the catalogue. The responsibility for selecting the correct size and checking the appropriate pricing is the responsibility of the purchaser. A receipt will be available on request. Once payment has been made, we accept no responsibility for returns due to mistakes in the purchasers ordering process. Image runs will be limited as stated in the online shop, after which no further copies will be produced or sold in that size or media. Images reproduced in Book Publications are not subject to these restrictions.
Prints are produced on Genuine Hahnemuhle Paper Stock - Photo Rag 308gsm, Torchon 285gsm or William Turner 190gsm, using UltraChrome K3 pigmented inks. Print runs are usually limited to 10 in each size (but in some cases may be less). All images are signed and numbered by the artist.
Your investment is protected using certified Hologram technology carrying a unique reference number on both the print and the Certificate of Authenticity. The image and reference number is also registered on the 'My Art Registry' Site run by Hahnemuhle. This system protects your asset and bogus prints cannot be passed off as originals. Once payment has been received, your image will be registered and you can check your print registration on the Hahnemuhle website using your unique six figure hologram reference in the search box provided. The embossing seal and artist signature is further proof of quality and authenticity.
Open Editions – Unless specifically described as a Numbered Edition series, all other reproductions will be deemed an Open Edition and are not limited by number, size or media type. Open editions carry a different embossing stamp and are not registered with Hahnemuhle.
All due care is taken over the production and shipping of your investment and is guaranteed to be perfect when dispatched to the purchaser, however, occasionally problems in handling during shipment can lead to damage. If you are in any way dissatisfied of the condition of your purchase and feel that you need to return the item(s), the ENTIRE shipment must be returned, together with written details of the fault so we can undertake a review of its condition and determine cause and accountability.
You have a maximum of 30 days from the date of receipt, to raise any issues with us either due to handling faults or mistakes in our purchasing information, in which case we will issue a replacement or full refund, provided the purchaser is not accountable. Issues raised after this time will not be considered.
Purchasers are advised to check carefully all personal details such as contact information, addresses and payment method as mistakes at this stage are not covered by our returns policy. All orders are FINAL.
You understand and agree that Temporal Art uses commercially reasonable efforts to display the colours of Original Works of Art, Digital Works and Printed Works accurately via the Site and printed media. However, because individual computer monitors may display colours differently, Temporal Art is not responsible for the colour accuracy of any Original Works of Art, Digital Works or Printed Works displayed, and disclaims all liability in this regard.
Monochrome images that are not true Black and White will have a description following the title, indicating it to be a Toned image.
All prices displayed on this site and printed media are in GBP (£) and inclusive of all UK taxes and revenue. However, Temporal Art is not responsible for duties required on imports by the purchaser within their own countries outside of the UK.
The Site, Services and Temporal Art Content are protected by copyright, trademark and other laws of the United Kingdom and foreign countries. Temporal Art exclusively own all right, title and interest in and to the Site, Services and Temporal Art Content and Printed Works, including all associated intellectual property rights. You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Site, Services or Temporal Art Content.
Temporal Art respects copyright law and expects all its visitors and customers to do the same. It is Temporal Art's policy to pursue legal action in appropriate circumstances of users who infringe our rights.
The Copyright of the images on this site and as provided under Service remains the property of Temporal Art (Tom Lee or his Assignees, Licensees or Agents as disposed of by the Tom Lee), under the terms of the Copyrights, Designs and Patents Act 1988 and subsequent amendments. The purchaser understands that they have acquired the right to own the Original Print(s) but that they have no rights over the content of the artwork.
The site user or purchaser acknowledges that duplicates, copies, in whole or in part may not be reproduced, distributed or transmitted in any form, including photocopying, recording (digital or analogue), or any method without the prior written consent of the author.

The failure of Temporal Art to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorised representative of Temporal Art.
